Privacy Policy of Lightworx Ltd/Landscape Photographer of the Year (“LPOTY”)

Lightworx Limited (LPOTY) takes the privacy of your personal information seriously and, when dealing with all data received from visitors to the site, will only use it in accordance with the current data protection law in the UK and this privacy policy. This privacy policy applies to personal information about individuals. It does not apply to information we hold about companies and other organisations.

1) How your information is collected

a) we collect information directly entered by you. For example, if you use the contact form or mailing list form on our website, enter our competition or email/write to us directly,

b) we collect information from your use of our website passively. We use tracking tools like browser cookies to collect information about your use of the service,

c) we collect information about users over time when you use this website,

d) occasionally from other third parties who may lawfully pass to us information about you, and

e) we combine information. For example, we may combine information that we have collected offline with information we collect online. Or we may combine information we get from a third party, such as PayPal who collect our online payments, with information we already have.

2) How your Personal Data is Used (All site users)

You do not need to supply personal data to view the website. However, please be aware that cookies are used to let us monitor how you are using the site, as these will help us make improvements for the future. These will not be linked to any information that allows you to be personally identified. Your IP address may also be used to examine usage trends, but, again, this will not allow for any identification. You can change the settings within your own browser if you wish to restrict the collection of such information. The 'Cookie' section gives advice on how to do this but please be aware that changing the settings may prevent you from taking full advantage of the website.

If you wish to sign up to our mailing list, you can do so via the form on our homepage. We use mailchimp.com to fulfil and manage our mailing list and, if you enter your information using the web form, it will be stored in our account with them, on their servers. We will send occasional newsletters and updates if you have asked to receive them but you can opt out at any time by clicking the ‘unsubscribe’ link at the bottom of each email or by contacting us via the email.

The ‘Contact us’ form accessed via a link at the bottom of our website homepage is supplied by Moore-Wilson and if you use this form to request information from us, the details given may be held for up to 18 months on their servers, until after the end of the active competition year. Personal data supplied in this way will only be used to answer the specific query initiated by you.

Personal Data Use (Additional for Entrants)

If you decide to enter the competition, you will need to supply personal data to enable us to manage your entry, and this may be used for a variety of purposes to facilitate this:

a) as an identifier for the images entered

b) to update you on the progress of your entry

c) to request further information about your entry

d) to respond to queries from you, and to help us to identify you when you get in touch

e) to notify you about changes affecting your entry

f) for accounts and general administration purposes

g) to carry out analysis and customer profiling

We do not collect financial information on our website. We use PayPal to process the payment of entry fees. When you complete the entry form, you will be diverted to PayPal’s site to make your payment and so will be subject to PayPal’s Privacy Policy for this financial transaction.

On the entry form there are two marketing questions:

a) You will be asked if you wish to receive newsletters and other marketing information from Landscape Photographer of the Year. If you select ‘yes’ then your details will be added to our list with mailchimp.com. Should you choose to receive marketing material, but then change your mind, you can opt out at any time by selecting the 'unsubscribe' option or by emailing us via the address below.

b) The second question asks if you wish to receive marketing information from organisations that are sponsoring or supporting the competition. If you choose to select this option, then your personal data may be passed to the relevant organisations. Once this information has passed from Landscape Photographer of the Year, it will be subject to the Privacy Policy of the organisation concerned and Landscape Photographer of the Year cannot accept any responsibility for any subsequent breaches of privacy that may occur.

If you decline the offer of receiving marketing material, then your personal data will be used by

Landscape Photographer of the Year to manage your entry as described above.

Landscape Photographer of the Year may also use your email address to inform you specifically of the launch of the next year’s competition.

3) Hyperlinks

The Landscape PhoTographer of the Year site does have links to other organisations. As soon as you leave the

Landscape PhoTographer of the Year site, you are recommended to check the Privacy Policy of the organisation before supplying any personal data. Landscape PhoTographer of the Year cannot be responsible for the protection of any data supplied to sites other than its own.

4) Sharing your information

We may share information about you as reasonably necessary for the effective running of the competition, with any of our employees, freelance personnel, sponsors and supporters, suppliers, agents, officers and sub-contractors.

We may, additionally, share your information:

a) In the event that we sell or buy, or plan to sell or buy, any business or assets, in which case we may disclose your personal data to the prospective buyer or seller of such business or assets,

b) With law enforcement & fraud prevention agencies so that they can tackle fraud. We will share information if we consider that we have to in order to comply with the law or to protect ourselves. We will share information to respond to a court order or subpoena. We may share information if a government agency or investigatory body requests it or if we are investigating potential fraud,

c) To the extent required by Law.

Organisations, who provide services to enable us to operate our business effectively, may be outside of the European Economic Area. If we transfer information outside of the EEA, we will make sure that the recipients agree to protect your information to the standard required within the UK.

5) Our legal basis for processing your Data

We will only process your information if we have a legal basis for doing so under current data protection legislation in the UK, including:

a) to pursue our legitimate interests (see below)

e) Request that we delete your data

If you give us information on behalf of someone else, you confirm to us that you have their permission to do so and that they are aware of the contents of this privacy policy and do not have any objection to our processing their information in accordance with this policy.
